Terms of Service
1. Introduction
These Terms of Service ("Terms") govern your access to and use of the digital eSIM plan services provided by LetsESIM ("we", "us", "our"), operated by an independent developer under the LetsESIM brand. By purchasing or using any LetsESIM digital eSIM plan, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. What We Provide
LetsESIM offers digital eSIM plans — software-defined mobile data access services that are provisioned and delivered electronically. No physical SIM card is shipped. Our eSIM plans grant you access to mobile data on third-party carrier networks at your destination, delivered via a QR code sent to your email address.
3. Eligibility
To purchase an eSIM plan, you must be at least 18 years of age (or the age of majority in your jurisdiction), and possess a device that is:
- eSIM-compatible (supports embedded SIM technology)
- Carrier-unlocked (not locked to a specific network operator)
- Running a supported operating system (iOS 12.1+ or Android 9.0+)
It is your responsibility to verify device compatibility before purchase. LetsESIM cannot issue refunds solely because your device is incompatible or carrier-locked.
4. Orders and Payment
All prices are displayed in US Dollars (USD). Payment is processed securely through our third-party payment processor. By completing a purchase, you confirm that you are authorised to use the payment method provided. LetsESIM reserves the right to cancel orders suspected of fraud or policy violations.
5. Digital Delivery
Upon successful payment, your eSIM QR code and installation instructions are delivered electronically to the email address you provided at checkout. Delivery is typically instantaneous but may take up to 24 hours in exceptional cases. You are responsible for ensuring your email address is correct at the time of purchase.
Each QR code is unique and may only be scanned once. You are responsible for safeguarding your QR code. LetsESIM is not responsible for loss resulting from you sharing or losing access to your QR code.
6. Activation and Use
Installation and activation of your eSIM are your responsibility. LetsESIM provides installation instructions but is not liable for activation failures caused by:
- Device incompatibility or carrier lock
- Incorrect installation steps performed by you
- iOS or Android software restrictions on your device
- Your device having reached its maximum eSIM profile limit
If you believe your eSIM failed to activate due to a technical error on our side, please contact us at [email protected] within 30 days of purchase.
7. Network Service and Coverage
Mobile data service is delivered via third-party carrier networks at your destination. LetsESIM does not own, operate, or control any telecommunications infrastructure. Accordingly:
- Network availability, signal strength, and data speeds depend entirely on the local carrier.
- Coverage may be limited or unavailable in certain geographic areas, including rural or remote regions.
- Temporary outages, congestion, and service interruptions may occur beyond our control.
- LetsESIM makes no warranty regarding network performance, data speeds, or uninterrupted connectivity.
By purchasing an eSIM plan, you acknowledge and accept these limitations.
8. Refunds and Cancellations
Please refer to our Refund Policy for complete details. In summary:
- A full refund is available within 30 days of purchase, provided the eSIM has not been activated.
- Once an eSIM plan has been activated, it is non-refundable. Activation constitutes delivery and consumption of the digital good.
- Activation status is determined by our system records. Scanning the QR code on a device constitutes activation.
By confirming your purchase, you acknowledge that you are purchasing a digital good and expressly consent to immediate digital delivery. If the eSIM remains unactivated, your right to a refund within 30 days is preserved.
9. Intellectual Property
All content on the LetsESIM website and application, including text, graphics, logos, and software, is the property of LetsESIM or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. Prohibited Uses
You agree not to:
- Use our services for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to circumvent, reverse-engineer, or interfere with the eSIM provisioning system
- Resell eSIM plans or QR codes without our express written authorisation
- Use our services to transmit spam, malware, or other harmful content
11. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.
12. Limitation of Liability
To the maximum extent permitted by applicable law, LetsESIM's total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount you paid for the specific eSIM plan giving rise to the claim. In no event shall LetsESIM be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, loss of connectivity, or business interruption.
13. Indemnification
You agree to indemnify and hold harmless LetsESIM from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of our services or your violation of these Terms.
14. Privacy
Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date at the top of this page. Your continued use of our services after any changes constitutes acceptance of the revised Terms.
16. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LetsESIM is established. Any disputes arising from these Terms or your use of our services shall first be addressed through our Complaint Policy. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of the applicable jurisdiction.
